The Electronic Frontier Foundation filed a motion in the secretive Foreign Intelligence Surveillance Court (FISC) last week. To challenge the secrecy of the FISC opinions, EFF had to navigate what they describe as a “Catch-22 environment.” While the Department of Justice argued that the FISC procedural rules barred the release of FISC opinions under the Freedom of Information Act, the FISC itself had pointed to the FOIA as the only avenue for accessing the opinions.
